General Terms and Conditions

1. Provider and Scope

The provider of this online shop is METESSO EOOD, trading name Marsely, бул. Асеновградско шосе № 4K, р-н Тракия, 4000 Пловдив, Bulgaria, Email: hello@marsely.com, UIC/EIK: 208891896.

These General Terms and Conditions apply to orders placed via the Marsely online shop. They also apply to entrepreneurs, unless a different individual agreement has been made. Individual agreements take precedence.

2. Product Presentation and Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order. By clicking the final order button, you submit a binding offer to purchase the goods contained in the shopping cart.

The automatic confirmation of receipt of your order initially only documents that the order has been received by us. A purchase contract is concluded as soon as we expressly accept the order, send an order confirmation, or confirm the dispatch of the goods.

If an order cannot be accepted in exceptional cases, we will inform you and refund any payments already received without delay using the original payment method.

3. Contract Text and Communication

The order data and these terms will be provided to you during the order process or by email. We use the contact details you provide for processing the order. You are responsible for ensuring that your email address and telephone number are correct and that messages can be received.

4. Prices, Shipping Costs, and Payment

The prices displayed in the shop are the prices applicable at the time of order. For deliveries within the European Union, they include the applicable VAT, where legally due. Shipping costs or other additional costs charged by Marsely will be transparently displayed before the order is completed.

The payment methods offered in the checkout may vary depending on the country of delivery and the order value. Payment is due according to the conditions of the selected payment method. Payment service providers may apply their own terms and conditions and privacy policies.

For deliveries to Switzerland, additional import VAT, customs duties, and customs clearance fees may apply. Unless these are expressly stated as included in the checkout, they are borne by the recipient.

5. Delivery

We currently deliver to Germany, Austria, the Netherlands, Belgium, France, Switzerland, Bulgaria, and Romania.

Delivery times are indicated on the product page or in the order confirmation. For furniture, the delivery time is usually 6–8 weeks. This longer delivery time is considered the agreed delivery period. Further details, particularly regarding freight forwarding delivery, appointment scheduling, and conditions at the delivery location, can be found in our shipping policy.

Partial deliveries are permissible if they are reasonable for you and do not incur additional shipping costs for you.

6. Retention of Title

The delivered goods remain our property until full payment of the purchase price.

7. Right of Withdrawal and Voluntary Returns

Consumers are entitled to the statutory right of withdrawal in accordance with our separate cancellation policy. Additionally, Marsely may grant a voluntary right of return. Conditions, deadlines, and possible return costs result from the cancellation policy and the return policy. Statutory rights are not restricted by a voluntary right of return.

8. Liability for Defects and Warranty

The statutory liability for defects and warranty rights apply. If goods are defective, you are entitled, under the statutory conditions, to supplementary performance or replacement delivery and, if the statutory conditions are met, to a reduction in price or withdrawal from the contract.

An additional voluntary warranty only exists if it is expressly promised for the respective product. It does not affect statutory rights.

9. Product Information and Material-Related Deviations

Product images are for illustration purposes. Screen display, lighting conditions, and natural material properties can lead to slight variations in color, structure, or grain. For natural materials, usual deviations are not a defect, provided that the agreed quality and ordinary usability are not impaired.

10. Liability

We are liable for damages in accordance with statutory provisions. Mandatory claims, particularly due to injury to life, body, or health, under product liability law, and in cases of intent or gross negligence, remain unaffected.

11. Cooperation in Delivery

You must provide a complete delivery address and accessible contact details and ensure that the goods can be delivered via existing access routes, doors, stairwells, or elevators. If delivery is not possible for reasons for which you are responsible, actually incurred and reasonable additional costs may be charged.

12. Data Protection

Information on the processing of personal data can be found in our privacy policy.

13. Applicable Law

The law of the Republic of Bulgaria applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies insofar as it does not deprive them of the protection granted by mandatory provisions of the state in which the consumer has their habitual residence.

14. Consumer Dispute Resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board. Statutory rights to appeal to competent authorities or courts remain unaffected.

15. Final Provisions

Should any provision of these terms be wholly or partially invalid, the remaining provisions shall remain effective. The relevant statutory provisions shall replace the invalid provision.
